According to the Indian law the man was invariably punished for infidelity. Recently the Supreme Court declared that punishing the husband for infidelity was unconstitutional. It can be the cause of divorce. However this law has been revised once again that for infidelity both partners will not be spared be it the man or the woman. Marriage is a sacred institution that both law and religion says so and infidelity cannot be taken lightly for both man and woman as they are violating the sanctity of marriage.

Interesting discussion, in practice infidelity can be committed by anyone, whether by husband or wife, even if it violates or violates religious rules and state law, but unfortunately you don't mention the punishment of a fine or imprisonment.

Earlier in India invariably the man was punished but now Supreme Court has declared that both partners can opt for a divorce on this ground but no punishment is unconstitutional.

Whatever you do with your private parts is your private business and the law or the government should not be concerned with people's personal lives. I don't think infidelity should be criminalized but I don't think it is a social act to cheat on your partner.

Our Indian culture is totally different. What law we Indians still think marriage as a sacred institution and don't support perversion or infidelity. Still today it's difficult for a divorcee to find a good partner. So we have to be very careful while choosing a partner before getting married.

Nice move, both parties have to own up to their wrong doings. This is one thing i do not support be it in marriage or even in a relationship.

I used to think that my country is the most conservative society in the world. But let me ask you something real quick? Is It true that the women pay for the hand of the men for marriage in India? Perhaps that could help me understand why marriage is considered so sacred over there.

Yes, it's still the system in India in the name of dowry which is considered a evil and has been made illegal by the court but everything is settled silently.

If that's true, and most times, it is the menfolk that cheat. It means they are trying to protect the women since they are the major stakeholders in that system of marriage.

In my own country, men pay for a ladies hand in marriage and when they cheat, it isn't regarded much as a big deal. It is a cultural difference thing.

Yes, it's a cultural difference. Still men in India cheat the women to remarry and accumulate more wealth. However the scenario has changed a lot. Many women are infidel these days and try to extract money from their husband if the file a divorce.
