According to the report, a domestic dispute over the video game Fortnite has led to a fatal shooting. Kelly Garcia, 43, has been charged with second-degree murder after allegedly shooting and killing his 26-year-old stepson, Azareel Martinez, during an altercation on Wednesday evening.
According to Davenport, police reported the incident began when Garcia and his wife, Adriane Daza, discovered their 9-year-old son playing Fortnite, a game they had forbidden. After disciplining the child and confiscating his cellphone, the boy reportedly retrieved a Smith & Wesson 9 mm handgun from a nightstand drawer in his parents' bedroom.
The stepdad was able to get the gun from the boy, however, Martinez entered the room in an agitated mood, and this angered the stepfather, causing him to shoot his stepson in his stomach. His stepson attempted to retreat, but the killer shot him twice in his back. Martinez was taken to a local hospital, where he succumbed to his injuries.
The killer stepfather faces charges of second-degree murder and unlawful storage of a firearm accessible to a minor. He was being held in the Polk County jail as of Thursday morning. If convicted of second-degree murder, Garcia could face a maximum sentence of life in prison.
